By soliciting our services, submitting data through our website, accepting our quote, and/or hiring us to provide our services of inspection, certification, engineering, and/or consultation, you agree to the Terms and Conditions of Service listed below.

1. Services

Soma Steel Ladder Co. offers fire escape inspections, engineering consultations, certification services, compliance support, permit applications, and related services for property owners, property managers, and building officials.

The scope of work for each job is set forth in writing in a proposal, estimate, service contract, or work order.

2. No Guarantee of Regulatory Approval

The purpose of our service is to provide our customers with help in complying with fire escape safety and inspection standards. However, we cannot guarantee that our assistance will be approved or accepted by any local government body, fire department, building department, inspector, insurer, or regulatory agency.

This will depend on the judgment of the governing authority concerned.

3. Client Responsibilities

The client agrees to:

  • Provide accurate property information.
  • Ensure safe and unrestricted access to all required inspection areas.
  • Obtain any permissions necessary for site access.
  • Disclose known structural concerns, repairs, alterations, or violations affecting the property.
  • Ensure the property is reasonably safe for inspection personnel.

Delays caused by lack of access or inaccurate information may result in additional fees.

4. Scheduling and Access

Appointments are scheduled based on availability. If an appointment is cancelled with less than 24 hours' notice, or if our personnel are unable to perform the inspection due to inaccessible conditions, unsafe conditions, or lack of authorized access, a rescheduling fee may apply.

5. Engineering Reports and Certifications

Engineering reports, inspection findings, and certifications are based on observations, information available at the time of inspection, and professional judgment.

Reports are intended solely for the client and project identified in the report and may not be relied upon by third parties without our written consent.

Conditions may change after the inspection date, and the Company assumes no responsibility for future changes, deterioration, damage, modifications, or alterations occurring after the inspection.

6. Property Conditions

Inspections are to be visual and non-invasive unless otherwise provided in writing. The Company assumes no obligation to discover defects or conditions which cannot readily be observed through the course of the inspection.

7. Terms of Payment

Payment is to be made in accordance with the payment terms specified within the proposal, invoice, or contract. The Company will retain the right to retain any documentation pending full receipt of payment. Interest and collection fees are allowable in the event of late payment.

8. Additional Services

All activities undertaken outside the scope of the original services such as further inspections, new reports, re-inspections, consultations, engineering modifications, permit services, and expedited services will attract additional costs.

9. Limitation of Liability

Liability of the Company with regard to any claims raised in connection with services provided is restricted in accordance with the terms of the law and the limitation of liability shall not be more than the amount paid by the Client for the respective service.

In no event shall the Company be liable for indirect, special, incidental, consequential, exemplary or punitive damages of any kind, including loss of profits or revenue.

10. Indemnification

The client agrees to indemnify, hold harmless, and defend the Company, its employees, engineers, consultants, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses in connection with:

  • Client's misuses of reports or certifications.
  • The client's provision of inaccurate information.
  • Conditions on the client's property outside the Company's control.
  • Any modification of the property after inspection or certification.

11. Intellectual Property

All reports, engineering documentation, certifications, photos, drawings, website content, graphics, and related documents shall remain property of Soma Steel Ladder Co., except as otherwise agreed in writing.

No document shall be copied, modified, distributed, or used for other purposes without the written consent of the owner.

12. Website Use

Users are prohibited from misusing, disrupting the functionality, attempting unauthorized access, and using any information from the website in an illegal manner.

The Company may terminate or suspend any part of the website without giving any prior notice to users.

13. Disclaimer

Any information provided through this website is intended to be general and informative and may not be used as legal, engineering, building codes, or professional advice regarding a particular property.

Only after a review of the property and the project will such recommendations be issued.

14. Governing Law

These Terms and Conditions shall be governed by and interpreted under the laws of the State of New Jersey, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved in the courts located within New Jersey.
